EMEKA IKE ADVICES ZIKITES

After 21 years of marriage, my wife wanted me to take another woman out to dinner and a movie. She said, “I love you, but I know this other woman loves you and would love to spend some time with you.”

The other woman that my wife wanted me to visit was my MOTHER, who has been a widow for 19 years, but the demands of my work and my three children had made it possible to visit her only occasionally. That night I called to invite her to go out for dinner and a movie. “What’s wrong, are you well?” she asked.

My mother is the type of woman who suspects that a late night call or a surprise invitation is a sign of bad news. “I thought that it would be pleasant to spend some time with you,” I responded. “Just the two of us.” She thought about it for a moment, and then said, “I would like that very much.”

That Friday after work, as I drove over to pick her up I was a bit nervous. When I arrived at her house, I noticed that she, too, seemed to be nervous about our date. She waited in the door with her coat on. She had curled her hair and was wearing the dress that she had worn to celebrate her last wedding anniversary. She smiled from a face that was as radiant as an angel’s. “I told my friends that I was going to go out with my son, and they were impressed, “she said, as she got into the car. “They can’t wait to hear about our meeting.”

We went to a restaurant that, although not elegant, was very nice and cozy. My mother took my arm as if she were the First Lady. After we sat down, I had to read the menu. Her eyes could only read large print. Half way through the entries, I lifted my eyes and saw Mom sitting there staring at me. A nostalgic smile was on her lips. “It was I who used to have to read the menu when you were small,” she said. “Then it’s time that you relax and let me return the favor,” I responded. During the dinner, we had an agreeable conversation – nothing extraordinary but catching up on recent events of each other’s life. We talked so much that we missed the movie. As we arrived at her house later, she said, “I’ll go out with you again, but only if you let me invite you.” I agreed.

“How was your dinner date?” asked my wife when I got home. “Very nice. Much more so than I could have imagined,” I answered.

A few days later, my mother died of a massive heart attack. It happened so suddenly that I didn’t have a chance to do anything for her. Some time later, I received an envelope with a copy of a restaurant receipt from the same place mother and I had dined. An attached note said: “I paid this bill in advance. I wasn’t sure that I could be there; but nevertheless, I paid for two plates – one for you and the other for your wife. You will never know what that night meant for me. I love you, son.”

At that moment, I understood the importance of saying in time: “I LOVE YOU” and to give our loved ones the time that they deserve. Nothing in life is more important than your family. Give them the time they deserve, because these things cannot be put off till “some other time.”

NIGERIAN GENIUS

Like I have always said, Nigerian students are no dull brains, they are only handicapped by the non-working atmosphere and condition created for them. Here is a solar-powered vehicle built by Oyeyiola Segun, a Part 5 student of the Electronic and Electrical Department of Obafemi Awolowo University.
In an exclusive interview by OAU Peeps Forum, he explained how the car came into existence and the motivations behind it.
OAU Peeps: Can we meet you sir?
Segun: Okay, I am Oyeyiola Segun, a part 5 student of Elect-Elect., OAU
OAU Peeps: We learnt you built this lovely car. Was it a joint project or you did it yourself?
Segun: I did it only. This is not a day’s job, I have been working on it for some months now.
OAU Peeps: So how does the car work?
Segun: Basically it depends on Wind and Solar energy. All the energy derived for these two sources were converted to run the simple car. There are different means of obtaining energy from these two sources but I picked the one that is cool for my car.
OAU Peeps: From what you just said, you can either use the Wind or Solar Energy to power the car’s engine?
Segun: Not either energy, rather both energies are used to power the car.
OAU Peeps: Cool… that differentiates your production from the usual vehicles we see around us I suppose?
Segun: Yes, you are very correct.
OAU Peeps: Could you share with us what actually provoked your innovation? I mean what you thought before coming up with this lovely engine?
Segun: Basically, it is because of the climate change we experience due to the combustion of fuel and you know cars also contribute to that change. So I thought of running a car that will not use fuel for its locomotion. After series of thinking and research work, I came up with the simple method that gave birth to this. So that is the basic reason for the car. Another concern of mine is to produce a car that will function effectively at a reduced cost of maintenance. I believe you know the price of fuel in this country is almost going beyond the reach of a common man?
OAU Peeps: Yes, you are right. Is there any other peculiarity of the car that you will like to share apart from the once you have mentioned?
Segun: Of course yes. Another thing that distinguishes my car from the common ones you see around is that you can know the state of the car through your mobile phones. I wrote a software that you can install which will give you the basic information about the car while in your room.
OAU Peeps: What do you mean by the State of the car?
Segun: I mean the functionality of the car, like the battery level, the weather conditions, the distance you can cover during different weather conditions. In case you have a bad weather. The car also has a GPS in it that helps to know the location of the car. These and many other features embedded in it.
OAU Peeps: Wow! this is very lovely. Do you have plans replicating this nice work in the future?
Segun: The work has come to stay, but I need to keep improving it for now.
OAU Peeps: It took you how many years to put this together?
Segun: That your question can be phased into two categories, do you mean mentally or physically?
OAU Peeps: Lol… you are right. Let us talk about the Physical aspect of it now.
Segun: Okay. We all know how our country is, I mean to get money is not easy but I pray that God will make it easy for everyone of us. The truth is, I cannot really say how long because I started using my personal little money to get the materials together. Let me just say about twelve(12) months.
OAU Peeps: Did you encounter any major challenge during this project?
Segun: Yes, Money. Even at the moment, I still need funds to get some others materials which are in my original paper design which I have not implemented on the car.
OAU Peeps: What will be the summarized cost of this car when fully ready?
Segun: There are lots of things that will lead to summary cost of production, so for now I cannot specifically state the cost but with all the materials that I will be needing since I am not producing in large quantities, its close to a million naira. Now quantifying my effect and others on foreseen cases.
OAU Peeps: Finally, your message to fellow Nigerian students?
Segun: My message to my fellow students is that Rome was not built in a day. It is better to start anything you want to do now and don’t never, I repeat, never expect someone to believe in your dreams because they may not understand it as you do. Endeavor to follow your heart and do what will make you happy and that which will not affect your fellow being negatively. May God help and bless us all.
OAU Peeps: Amen. Thank you so much Engineer, we are indeed proud of you.
Segun: You are welcome and May God help OAU Peeps Forum too.

ARSENAL IN TROUBLE

Manchester City will look to compound Arsene Wenger’s woes when they visit the Emirates stadium on Saturday, knowing a win would take them closer to the Premier League title and inflict a potentially fatal blow to Arsenal’s chances, according to Reuters.
Wenger’s side have capitulated in recent weeks and a win for Manuel Pellegrini’s team in London would almost certainly leave the battle for the Premier League crown as a three-way race between City, Liverpool and Chelsea.
Arsenal, humiliated 6-0 at leaders Chelsea and held to a 2-2 home draw by Swansea City after conceding a last-minute equaliser on Tuesday, would have hoped for an easier match to revive their ailing title bid.
City lie third with 66 points, three behind Chelsea but with two games in hand, and they will look to build on their impressive 3-0 win at bitter local rivals Manchester United on Tuesday.
Jose Mourinho’s Chelsea travel to struggling Crystal Palace and second-placed Liverpool, only a point off the top on 68 points, host Tottenham Hotspur.
It is 10 years since Arsenal last won the league and they approach the match on Saturday looking not only to keep their slim title hopes alive but to cement a place in the top four and qualify for next season’s Champions League.
Fifth-placed Everton are breathing down their necks, six points adrift of Wenger’s men but with a game in hand and a trip to bottom club Fulham on Sunday presents the chance to move a step closer to the top four.
Wenger endured a torrid time in his 1 000th match in charge of Arsenal at Stamford Bridge and anticipates another tough match against City.
“Manchester City had a good result tonight (against United), they look a bit unstoppable and are favourites because they still have two games in hand,” Wenger said.
“Them and Chelsea are the favourites for the title. We don’t have too much room to come back into it.”
City beat Arsenal 6-3 at home this season but captain Vincent Kompany said the trip to the Emirates Stadium was a potential stumbling block.
“It’s just one little step. The other teams are still very good,” the Belgium defender told reporters.
“With the game against Arsenal, obviously it’s good in a way, because you don’t have to make a big effort to get the lads focused again.”

BEST WISHES DURING THE EXAMS MY FRIENDS

REMOVE THAT RUBBISH THAT HAS HINDERED OUR DEVELOPMENT

Delegates at the ongoing National Conference in Abuja may vote in favour of the removal of immunity clause from the constitution, if the growing consensus of opinion on this issue among members is anything to go by.
Saturday PUNCH investigations showed that proponents of an amendment to Section 308 of the Nigerian Constitution, which deals with immunity for the President and state governors, had begun moves to ensure that the proposal sailed through.
Saturday Punch  learnt that the proponents were already discussing with other delegates to ensure they got the required votes to delete the clause from the nation’s constitution.
Further checks revealed that delegates from across the country were ready to vote against the clause.
In separate interviews with Saturday PUNCH, delegates from different parts of the country supported the removal of immunity clause especially for criminal cases.
According to them, any president or governor that commits a criminal offence should step aside for prosecution.
The House of Representatives, in its ongoing constitutional amendment debate, had voted in favour of the amendment of Section 308 of the constitution which stipulates immunity for selected elected government functionaries.
The amendment seeks to remove immunity from a President or governor facing criminal prosecution.
But the Senate retained the immunity clause for both civil and criminal suits. Both chambers will meet later to reconcile their positions.
Specifically, Section 308 of the constitution states, “Notwithstanding anything to the contrary in this constitution, but subject to subsection (2) of this section.
“(A) no civil or criminal proceedings shall be instituted or continued against a person to whom this section applies during his period of office;
“(B) A person to whom this section applies shall not be arrested or imprisoned during that period either in pursuance of the process of any court or otherwise; and
“(C) No process of any court requiring or compelling the appearance of a person to whom this section applies, shall be applied for or issued;
“Provided that in ascertaining whether any period of limitation has expired for the purposes of any proceedings against a person to whom this section applies, no account shall be taken of his period of office.”
The section applies to the President, the vice-president, state governors and their deputies.
But opposing this section of the constitution, delegates at the National Conference from the north, in separate interviews with Saturday PUNCH, argued that the immunity clause was being used as a cover-up by corrupt public office holders to loot the nation’s treasury.
A conference delegate of the civil society groups, Auwal  Rafsanjani, said the clause had outlived its usefulness and should be removed.
According to him, the immunity clause, has over the years, been used as a cover-up for the looting and outright stealing of Nigerians’ common patrimony.
He said, “It is so bad that the people who enjoy this immunity evade justice even after their tenure because of our weak and corrupt institutions.
“You can get away with acts of corruption especially if you are a member of the ruling party. In other words, immunity has served as an incentive for those who want to loot.
“The only reason some people are  requesting that immunity be retained is to protect public office holders from being distracted. But anybody taking up public office must realise that if they do anything wrong, they must face the music.”
Rafsanjani explained that in other climes, when a public office holder commits a crime, he either resigns, or is asked to go and face prosecution.
This, he said, makes public office holders to be careful and desist from doing things that could portray them and their offices in bad light. He explained that the reverse was the case in Nigeria because people commit these crimes with impunity.
He reiterated that these crimes were not restricted to financial crimes, adding that they included human rights violations and other infractions.
Another delegate from Kano State, Dr. Junaid Mohammed, said he would support the retention of the immunity clause only for the president and the vice-president.
He said, “I expressed the position of Kano State on the issue in the last exercise which is that immunity should be confined to the sovereign who should be the President and the Vice- President.”
Mohammed said the position was accepted unanimously but later dropped following arguments put forward by a retired court judge who joined the discussions later.
He, however said, “Now the issue is coming back and I have no doubt in my mind that this conference as I see it, given  the opportunity, will vote the immunity clause out and retain only that of the sovereign.”
Another delegate from Borno State, Mohammed Kumaila, said, “I believe it should be removed as it would enhance good governance, reduce impunity and corruption.”
However, the Secretary General of the Middle Belt Forum, Mr. John Dara, has a slightly different opinion.
He said, “The President should still enjoy full immunity, while governors should be given partial immunity.
“An American governor was caught saying on telephone that he would sell a vacant senatorial seat.
“He was indicted and impeached. Governors should be protected from civil litigations (and) not from criminal offences which include corruption offences.”
Also, the spokesperson for the pan-Yoruba socio-political group, Afenifere, Mr. Yinka Odumakin, said that the clause must be expunged from the constitution to tackle corruption in the country.
He said, “I back the removal of immunity clause because when you have a presidential system of government and you have immunity clause, you are building a monarchy.
“To that extent, immunity mandates corruption. For civil offences, immunity can stay; but for criminal offences, immunity must go.
“To tackle corruption in this country, you have to change the constitution. When you concentrate power in the centre, it brings two things–corruption and inefficiency. The structure we run presently encourages and mandates corruption. Until we change that, we cannot move forward.’’
In the South-South,   a former Minister of Housing, Chief Ndueso Essien, said many Nigerians would support the removal of immunity clause because governors had been enjoying so much power while some of them had been operating recklessly.
Essien expressed the need for the President and governors to be protected from civil litigations.
According to him, such litigations could distract the Executive from achieving its developmental goals.
He stated, “Definitely, many of us support the removal of the immunity clause in the Nigerian Constitution because it (immunity clause) has given the governors too much power. Some of them operate recklessly. That is why some of them are desperate to be in the Senate.
“However, they (President and governors) should be protected from civil litigations in order to avoid anything that will prevent them from achieving their developmental goals for the state and the country,” Essien said.
On how to solve the problem of corruption, he said, “The concentration of so much power at the centre is not good for the country. When the military took over in 1966, they adjusted the constitution to suit the military government.

THE OBAMAS CALLED MONKEY BY A BELGIAN NEWSPAPER

Despite the long gone fight against racism around the world, President Barack Obama and first lady Michelle Obama are at the center of another recent racist attack. A Belgian newspaper De Morgen, which marked Obama's recent visit to the Netherlands to commemorate their 100th anniversary of the start of World War I; with a picture of the first couple with ape mouths.
The publication even went further by posting another photo of the US President with the following caption: "First black president of the USA starts selling weed.”
Reports say De Morgen Newspaper ran the photos alongside a story that was supposed to be a "satirical" take on Obama's strained relationship with Russia's president Vladimir Putin.
But it looks like it was the Russian Leader himself who allegedly forwarded the photos to the Belgian media house, "Vladimir Putin is the president of Russia. He sent us this attachment at our request, and chose to send pictures instead of text 'because he doesn't have a lot of time'," the article reportedly stated.
However, Nigeria writer Chika Unigwe has shared his thoughts on the article on Twitter with this post:
@chikaunigwe – so photo of the Obama's as chimps in De Morgen of today is the paper's attempt at satire. I forgot to laugh #racist
The negative feedbacks from people across the globe including that of Chika apparently caused the paper to apologize for the offensive image of the First Couple and admits they showed "bad taste" by publishing it. The paper wrote:
"When you consider the fragment apart from its context, which is a properly worked out satirical section, then you don’t see the joke but just a picture evoking sheer racism …We wrongly assumed that racism is no longer accepted, and that in this way it could be the subject of a joke.”
SMH! Do you think this was a joke to be published at all or it was a deliberate act to ridicule the US First Couple? Send us your thoughts.

This generated a national protest with Nigerians calling for the  sacking of the Minister of Interior, Mr. Abba Moro.

NADIA BUARI STILL WEARS JIM IYKE RING EVEN AFTER RUMOURS

Seems Ghanaian actress, Nadia Buari and Jim Iyke are fooling us all as the photo she just posted shows her still wearing same ring presented to her by the actor on his TV reality show.

I thought Nadia later said the ring wasn't meant to be a real proposal and Iyke also came out speaking in parable. So why is she still wearing the ring?

Besides, she seems to enjoy tweeting in Arabic these days. Something tells me she's trying to code something from us.
After posting the photo of her and Iyke loving up inside a private jet then, she tweeted in Arabic with the engagement ring still on her finger.

Jonathan meets Pope, justifies anti-gay law

President Goodluck Jonathan on Saturday met with Pope Francis and the Vatican’s Secretary of State, Monsignor Pietro Parolin, in Rome.
Christian pilgrims from Anambra, Kaduna and the Federal Capital Territory, were part of the President’s  delegation to the Vatican City but they remained at the courtyard while the papal audience lasted.
The Executive Secretary of Nigeria Christian Pilgrims Commission, Mr. John Kennedy-Opara, who was part of the President’s delegation, told journalists that Jonathan used the opportunity of the papal audience to explain Nigeria’s position on same-sex marriage to the Pope.
Jonathan had on January 7, signed the Same-Sex Marriage (Prohibition) Bill 2013 into law despite opposition from some Western countries.
Kennedy-Opara also said the Pope commended the President for the efforts being made by the Federal Government to tackle the mirage of challenges facing the country.
The Pope was also said to have rendered special prayers against the current insecurity being witnessed in parts of the country while bilateral talks on education, health and others issues were said to have been discussed.
Nigeria’s Ambassador to the Holy See, Dr. Francis Okeke, also told journalists that Jonathan’s visit was an attempt to re-establish contact with the Holy See authorities because they have an important part to play in Nigeria’s affairs.

JONATHANOPHOBIA

Today while surfing the net, I bumped upon this comment someone made concerning an award presented to our president in Namibia... enjoy

Scientists have discovered a new disease in Nigeria. This disease is mostly prevalent in Southwestern Nigeria with traces in other parts of the nation. The South-South and South-East are the least affected. The disease is called Jonathanophobia. Jonathanophobia has grave effects if not treated on time. It leads to high BP, cardiac arrest, stroke and consequently death. This disease has affected many Nigerians. It is predicted that the grave effects of this dreaded disease will be visible in many areas of Nigeria come 2015. Those who don't diagnose their own early in order to take adequate precautions will be affected. From predictions it will begin to manifest after 14 February 2015 when the results of the presidential polls will be announced. Check yourself if you have the symptoms and get healed. This is the first warning!

DRUG KINGPIN CAUGHT

One Month After Drug Lord El Chapo Guzman's Arrest, Narcotics Business Continues With No Change

The extraordinary arrest of one of the world’s most wanted criminals, Mexican drug kingpin Joaquín El Chapo Guzmán Loera, was universally hailed as the most important blow against organized crime since Colombian drug lord Pablo Escobar was killed more then two decades ago. Yet, a month after his capture, violence in Mexico continues unabated and there is no indication that the flow of illegal drugs into the U.S. has diminished.
U.S. law enforcement officials admit that El Chapo’s detention has a great deal of symbolism. “He needed to go down. Will it change things here? I don’t know, but it was important to catch him because it sends a strong message against impunity,” a law enforcement official told me.
Under Guzmán’s leadership, the Sinaloa Cartel, one the world’s best organized multinational criminal corporations with an estimated annual revenue of over $3 billion, was responsible for 25% of all illegal drugs that enter the U.S. via Mexico. This is not expected to change now that he is behind bars. Most likely, there is already a new CEO,
Roberto Saviano, an Italian writer and journalist;
Roberto Saviano, an Italian writer and journalist (Photo credit: Wikipedia)
very much like with any other transnational corporation that transcends one man. This guarantees that the flow of drugs continues uninterrupted to  the U.S, the largest market of illegal drugs, and that the cartel’s profits do not dry up.
Ismael “El Mayo” Zambada, El Chapo’s right-hand man in charge of logistics, is widely believed to be the new king. “Zambada will likely resume as the leader to replace Chapo and the quasi-autonomous nature of their cartel will keep some of the supply veins operating”, David Gaddis, former chief of enforcement operations at the DEA, told me following El Chapo’s arrest. Like El Chapo, Zambada was born in the Pacific coast state of Sinaloa where he has had a successful 50 year criminal career. But, contrary to El Chapo, Zambada has never been caught, despite a $5 million reward U.S. authorities have put on his head. He is believed to be hiding in the mountains. Zambada is the only Sinaloa drug lord who has given an on-the-record interview. In 2010, he told senior Mexican publisher Julio Scherer that he “panics about the idea of being locked up.”
Experts say that most likely El Chapo and Zambada are still active partners, since jail will not stop Guzmán. Mexican journalist Anabel Hernández, author of Narcoland: The Mexican Drug Lords and Their Godfathers, told Spain’s news agency EFE that, “Through his attorneys, which he has the right to see once or twice a day, he can send money, order operations, support his family and send drugs. El Chapo’s power is far from over.” The last time El Chapo was in jail, from 1993 until 2001 when he escaped, he continued doing business as usual, thanks to the protection of an army of corrupt jail guards, servants, cooks and even women that visited him regularly, Hernández said. “He even had access to Viagra.”
Under Guzmán’s leadership, the Sinaloa Cartel geographically expanded its criminal business, currently stretching throughout the Americas, Europe, Australia and Asia. At the same time, the Cartel diversified into every type of drug Americans have smoked, inhaled, injected or swallowed, from marijuana and cocaine to methamphetamines and heroine.
In an article for Italy’s La Repubblica, Roberto Saviano, a world-renowned crime expert and Italian writer, called El Chapo the “Steve Jobs of cocaine” because of his unusual “genius” to foresee new opportunities in the markets. Saviano, who moved from Naples to an undisclosed location after being threatened by the Italian mob, told CNN en Español that El Chapo, “Is a remarkable figure, a real criminal, not a gangster. Criminals have rules, gangsters have instincts.”
As long as Mexico shares a 2,000 mile border with the U.S., the drug business will not only survive but continue flourishing, regardless of how many powerful kingpins are arrested.
Since 2009, El Chapo has been included in Forbes’ Most Powerful People list.

DIEZANI IN DANGER

The House of Representatives on Thursday passed a resolution to probe an alleged expenditure of N10bn by the Minister of Petroleum Resources, Mrs. Diezani Alison-Madueke, to charter and maintain a jet for her personal use.

The sponsor of the motion, Mr. Samuel Adejare, told the House that the minister maintained the aircraft for two years.

In the last two years, the minister has committed at least N3.120bn in maintaining the private jet, which is used solely for her personal needs and those of her immediate family, which is an appalling act,” he said.

He alleged that other “wasteful” costs associated with the minister’s frequent trips with the jet were “currently estimated at N10bn, which include payment of allowances to the crew for trips, hanger parking and rent based on the lease agreement.”

The All Progressives Congress lawmaker from Agege Federal Constituency in Lagos State, argued that, at a time of dwindling resources, it was a “breach of public trust” and “impudence” for a government official to fly “all over the world, obviously for leisure.”

Members endorsed the motion in a unanimous voice vote and directed the Committee on Public Accounts to conduct the investigation within three weeks.

In another resolution, the House observed that the Nigeria Liquefied Natural Gas had not remitted revenue to the Federation Account since 2004.

It resolved that its Committee on Gas Resources should investigate the issue within three weeks as well.

A member from Kano State, Mr. Aminu Suleiman, had brought the matter before the House.

Part of Suleiman’s motion reads, “The House notes that the NLNG Bonny, in flagrant disobedience and breach of Section 162(1) of the 1999 Constitution has not remitted funds accruing to it to the Federation Account form 2004 till date.

“That the non-remittance of funds accruing to NLNG Bonny from 2004 till date has adversely affected the Federation Account to the detriment of Federal, States and Local Governments.

“That the unpatriotic actions of those in charge of the NLNG bonny from 2004 till date has resulted in loss of huge revenue that ought to be shared to all tiers of the government form the Federation accounts for both recurrent and capital development.

“That, the non-remittance of funds that accrued to NLNG Bonny to the Federation account from 2004till date has badly affected all critical sectors of the Nigerian economy and constitute an economic crime.”

US Lawyers Seek Repatriation of Abacha Loot to Nigeria

Two US senior lawyers and professors of law have asked the Eric Holder, Jr. the Attorney General of United States of America to without delay repatriate the sum of $458 million assets stolen by the former dictator late General Sani Abacha and his accomplices.
The lawyers Alexander Sierck and Nicholai Diamond of Cameron LPP in Washington DC sent the letter dated 18 March 2014 as Volunteer Counsel for Socio-Economic Rights and Accountability Project (SERAP).
In the letter titled ‘Re: Abacha Kleptocracy Forfeiture Action’, the lawyers said “SERAP respectfully requests that the U.S. Department of Justice establish a general process for the repatriation of assets seized as part of its Kleptocracy Initiative. SERAP’s request arises in the specific context of the Department’s March 6, 2014 announcement that it has frozen more than $458 million in corruption proceeds, which have been hidden in bank accounts around the world by former Nigerian dictator Sani Abacha and conspirators, to implement the civil forfeiture complaint filed in federal district court here in Washington. As the Department stated in its press release announcing the seizure, these seized funds properly belong to the citizens the kleptocrats ostensibly served.”
According to the lawyers, “Even though the Department has only recently filed the civil forfeiture complaint regarding the Abacha-related assets, SERAP respectfully submits that its request is nonetheless timely in regard to such assets. This is because in many such cases, the kleptocrats owning the seized property do not appear in the U.S. to contest the seizure because they would then subject themselves to personal jurisdiction in the underlying criminal case that might be filed against them. Thus, at some point, perhaps by the end of 2014, there will be a default on the Abacha asset seizure, consequently freeing up the assets for repatriation to or for the benefit of Nigeria and its citizens.”
“SERAP notes that in a September 19, 2011 interview with the Main Justice blog, Jennifer Shasky, speaking on behalf of the Department’s Kleptocracy Initiative, stated that: the Department has no [legal] obligation to repatriate assets subject to civil forfeiture, but that the Department is committed to finding ways to repatriate or otherwise use such funds for the benefit of the victim country. SERAP assumes that this is still the Department’s position,” the lawyers also said.
They also noted that, “on March 15, 2012, SERAP filed a letter with the U.S. Securities and Exchange Commission’s Enforcement Division seeking comparable repatriation of civil fines paid in connection with Foreign Corrupt Practices Act settlements. In particular, SERAP proposed that such fines be repatriated to or for the benefit of the people of the victim country in the event that the SEC determined not to pay such proceeds directly to the government where officials were apparently bribed. To that end, SERAP proposed that such funds might be conveyed to a reliable U.S. or Nigerian charitable organization to be spent on health care, for example, subject to anti-corruption safeguards.”
The lawyers also “requests that the Department publish for public comment a proposal for the disposition of such seized assets, not just in the Abacha context but in all such Kleptocracy Initiative cases. In SERAP’s judgment, the Department’s proposal ought to explain:
·         When and under what circumstances the Department will “foreclose” on such seized, and presumably defaulted, assets.
·         Whether and when the Department will provide public notice of such foreclosure.
·         Whether, following such foreclosure, the Department will provide public notice, of 90 days for example, for requests for repatriation to be filed.
·         The criteria the Department would consider, on its own or in response to a request, in deciding whether to repatriate such funds; such criteria might include (i) the integrity of the relevant foreign government, (ii) that government’s proposed uses of such repatriated funds, including anti-corruption safeguards, and (iii) where and under what circumstances the Department would prefer to repatriate such funds to a charitable organization for public benefit purposes, e.g., healthcare, in the victim country.”
