Council at its 91st meeting held on thursday, 7th of November 2013
considered the report of the appeals and petitions committee of
council on the petition of the academic staff union of universities
(ASUU), Nnamdi Azikiwe University dated...
29th of August, 2013 titled as
above and noted as above:
1. That the Act of 1993 by which section 4 of the Universities
(Miscellaneous) (Provisions) Act 2012 now provides retirement age as
seventy (70) years for academic staff on professional cadre.
2. That the incumbent VC would not be due for retirement on 11th of
Nov. 2013 but would be due for retirement on attainment of seventy
(70) years in Nov. 2018; and
3. That based on the appeals and petitions committee wide
consultations on the matter study on the personal practices in that
regard in some Nigerian Universities, as applicable since the
emergence of the new act on retirement age, the incumbent VC is still
legally and officially serving withing his approved 5-year term.
After as exhaustive consideration of the foregoing observation,
council approved as follows:
a) That by virtue of the amended act of 1993 by the universities
miscellaneous provisions Act 2012, prof. Boniface Egboka will now
retire at the age of 70 as applicable to academic staff on
professional cadre; and
b) That he should, following from (a) above, vacate the seat of
Vice-chancellor at the end of your 5-year tenure counting from the
date of appointment as substantive Vice-chancellor on 3rd of June,
2009.
Accordingly, he should continue in office as lawfully appointed
Vice-chancellor of the University until 3rd of June, 2014.
